These Terms of Service ("Terms") govern your access to and use of vulcani.io and any services or communications offered by Vulcani ("Vulcani," "we," "us," or "our"). By accessing the website, providing your information, or engaging us for services, you agree to these Terms.
If you do not agree to these Terms, do not use the site or services.
1. The Services
Vulcani provides custom AI agent development services, including but not limited to voice agents, SMS agents, chat agents, lead-qualification automation, customer-support automation, and related integrations. The specific scope, deliverables, and fees for any client engagement are defined in a separate written agreement (proposal, statement of work, or order form). In the event of a conflict between these Terms and a signed engagement agreement, the engagement agreement controls.
2. Eligibility
You must be at least 18 years old and authorized to act on behalf of any business you represent in order to engage our services or submit information through this website.
3. SMS / Text Messaging Terms
The following terms apply to any SMS messages you receive from Vulcani.
Program description
Vulcani may send SMS messages for the following purposes:
- Confirmations and reminders for scheduled meetings or calls
- Follow-ups about your inquiry, discovery call, or active project
- Transactional notices such as proposal status, project milestones, and billing notifications
- With your prior consent, occasional informational or promotional messages from Vulcani
How you opt in
You opt in to receive SMS messages from Vulcani by providing your mobile number through our SMS-opt-in form on vulcani.io, by giving it to us directly in a meeting or email, or by replying to a confirmation SMS we send you.
Message frequency
Message frequency varies based on the activity in your inquiry or engagement.
Cost
Standard message and data rates may apply, depending on your mobile carrier and plan.
Opt out
You can opt out at any time by replying STOP to any SMS from Vulcani. After you reply STOP, you will receive a single confirmation message and no further messages.

Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Compatible major U.S. carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, and others. Message delivery depends on carriers, devices, and network conditions, and is not guaranteed.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other information-sharing categories described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Acceptable Use
You agree not to use the site, services, or any communications from Vulcani to:
- Violate any applicable law, regulation, or third-party right
- Infringe any intellectual property, privacy, publicity, or other right
- Send spam, unsolicited communications, or harmful, threatening, harassing, or unlawful content
- Distribute malware, conduct phishing, or interfere with the security or integrity of any system
- Reverse-engineer, decompile, scrape, or attempt to gain unauthorized access to our website, systems, or any agents we develop
- Impersonate any person or entity or misrepresent your affiliation
5. Intellectual Property
All content on vulcani.io — including text, images, graphics, code, design, the VULCANI mark, and the overall look and feel — is owned by Vulcani or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except as expressly permitted by law.
Ownership and licensing of any deliverables produced for a specific client engagement (for example, a custom AI agent built for your business) are governed by the engagement agreement.
6. Third-Party Services
Vulcani-built agents and certain features of vulcani.io may rely on or integrate with third-party services (for example, Twilio, Anthropic, OpenAI, ElevenLabs, Google, Slack, HubSpot, Cal.com). Your use of those services is subject to their respective terms and privacy policies. Vulcani is not responsible for the practices, availability, or content of third-party services.
7. Fees and Payment
Fees, payment terms, and refund policies for client engagements are set out in the applicable engagement agreement. Unless that agreement says otherwise, fees are non-refundable once work has begun.
8. Disclaimer of Warranties
vulcani.io and any free tools, demos, or general information offered through the site are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied — including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Any warranties applicable to a paid client engagement are set out in the engagement agreement.
9. Limitation of Liability
To the maximum extent permitted by law, Vulcani and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or any communications from us — even if Vulcani has been advised of the possibility of such damages. Vulcani's total aggregate liability for any claim arising out of or relating to the site (separate from any signed engagement agreement) is limited to one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Vulcani from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your violation of any law or third-party right, or your misuse of the site or services.
11. Governing Law and Venue
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the site will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be posted on this page. Your continued use of the site after an update constitutes acceptance of the updated Terms.
13. Termination
We may suspend or terminate your access to the site at any time, with or without notice, if we believe you have violated these Terms or applicable law. Sections of these Terms that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Vulcani is operated as a sole proprietorship by Juan Gonzales, based in San Diego, California, USA. Throughout these Terms, "Vulcani," "we," "us," and "our" refer to this business and its owner.
